Background
The Minerals Regulation Commission (MRC) is a statutory body established under the Minerals Regulation Commission Act No. 14 of 2024 to regulate, monitor and facilitate the sustainable development of Zambia’s mineral resources sector. The establishment of the Commission represents one of the most significant institutional reforms in Zambia’s mining governance framework since the privatization era of the late 1990s.
For decades, Zambia’s mining sector was administered under various iterations of the Mines and Minerals Development Act, most recently the Mines and Minerals Development Act No. 11 of 2015. During this period, the Ministry responsible for mines exercised both policy-making and regulatory functions. While this framework supported the growth of the sector over the years, it increasingly presented challenges associated with overlapping mandates, fragmented regulatory oversight, administrative inefficiencies and concerns regarding regulatory independence.
Regulatory responsibilities were distributed across multiple offices, including the Director of Mines, Director of Mining Cadastre and Director of Mines Safety, resulting in operational bottlenecks and prolonged decision-making processes. In addition, stakeholders frequently raised concerns regarding delays in the processing of mining rights, limited coordination across regulatory functions and the need for greater transparency, predictability and efficiency within the mineral sector governance system.
Recognising mining as a strategic pillar for national economic transformation, the Government of the Republic of Zambia, under the leadership of President Hakainde Hichilema, initiated comprehensive reforms aimed at strengthening mineral resource governance and creating a more investor-friendly, transparent and accountable regulatory environment. These reforms were further driven by the national aspiration to significantly increase mineral production, expand investment, formalise artisanal and small-scale mining activities, enhance compliance monitoring and maximise long-term social and economic benefits from Zambia’s mineral wealth.
In 2024, the Minerals Regulation Commission Bill was introduced before Parliament with the objective of establishing an independent and specialised institution dedicated to mineral sector regulation and oversight. The reforms sought to separate policy formulation from technical regulatory functions in order to enhance institutional efficiency, professionalism, consistency and public confidence in the administration of the mining sector.
The Minerals Regulation Commission was subsequently established through the Minerals Regulation Commission Act No. 14 of 2024, assented to on 20th December 2024. The Act provides the legal framework for the regulation, monitoring and coordination of activities across the mineral value chain and positions the Commission as the principal regulatory institution responsible for ensuring responsible and sustainable mineral sector development in Zambia.
The establishment of the Commission introduced significant institutional and regulatory reforms aimed at modernising Zambia’s mineral governance architecture. These include strengthening compliance and enforcement mechanisms, improving transparency and efficiency in the administration of mineral rights, promoting responsible mining practices, enhancing technological systems for monitoring and reporting, supporting value addition and local participation, and fostering greater stakeholder collaboration within the sector.
Today, the Commission plays a central role in safeguarding national interests in the mineral sector by promoting ethical, transparent and sustainable mineral resource development. In executing its mandate, the MRC works closely with Government institutions, mining companies, local communities, traditional leaders, cooperating partners, investors and civil society organisations to ensure that Zambia’s mineral resources contribute meaningfully to long-term national social and economic prosperity.
The Commission remains committed to fostering an ethical, responsible and sustainably developed mineral sector anchored in effective policy, robust regulation and accountable governance for the benefit of present and future generations.
